Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ttny.io website and URL shortening service operated by ttny.io ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

These Terms constitute a legally binding agreement between you and ttny.io regarding your use of the Service. The Service is offered subject to your acceptance of these Terms and all other operating rules, policies, and procedures that may be published by ttny.io.

1. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Account Security

You are responsible for maintaining the security of your account and password. ttny.io cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

Account Eligibility

To be eligible to use the Service, you must:

  • Be at least 13 years of age (or the minimum legal age in your jurisdiction)
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable law

Account Types

ttny.io offers different types of accounts with varying features and pricing. By selecting a specific account type, you agree to the terms and conditions specific to that account type, including any applicable fees and usage limitations.

2. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe upon the rights of others or violate their privacy or publicity rights
  • Impersonate any person or entity
  • Engage in any activity that interferes with or disrupts the Service
  • Distribute viruses or any other technologies that may harm ttny.io or the interests of its users
  • Harvest or collect user information without their consent
  • Shorten URLs that lead to phishing, malware, or other harmful content
  • Use the service for spamming purposes
  • Attempt to gain unauthorized access to any portion of the Service
  • Probe, scan, or test the vulnerability of the Service or any network connected to the Service
  • Bypass or circumvent measures employed to prevent or limit access to the Service
  • Use any automated system, including "robots," "spiders," or "offline readers" to access the Service in a manner that sends more request messages to the Service than a human can reasonably produce in the same period

Prohibited Content

You may not use the Service to shorten URLs that link to content that:

  • Is illegal or promotes illegal activities
  • Is defamatory, obscene, pornographic, vulgar, or offensive
  • Exploits or harms minors
  • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
  • Is violent or threatening or promotes violence or actions that are threatening to any person or entity
  • Promotes illegal or harmful activities or substances
  • Infringes or violates the intellectual property rights or any other rights of others

Usage Limitations

ttny.io reserves the right to impose reasonable limitations on the use of the Service, including but not limited to the number of shortened URLs, API requests, and clicks that may be processed within a given time period. These limitations may vary based on your account type and are designed to ensure the stability and availability of the Service for all users.

3. Content

Our Service allows you to shorten URLs that link to content that is not owned by ttny.io. ttny.io has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that ttny.io shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Content Monitoring

ttny.io does not pre-screen or monitor the content of shortened URLs. However, we reserve the right to remove any shortened URL or terminate any user account if we become aware that the URL or account is being used in violation of these Terms.

Reporting Violations

If you believe that a shortened URL violates these Terms or any applicable law, please report it to us at abuse@ttny.io. Please include the shortened URL and a description of the violation in your report.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ttny.io and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ttny.io.

Your Content

You retain all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with providing the Service.

Feedback

Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit without any obligation to you.

5. Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Service Availability

ttny.io will make reasonable efforts to keep the Service operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. ttny.io reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the Service, with or without notice.

API Changes

If you use the ttny.io API, you acknowledge that we may change, deprecate, or republish APIs for any Service or feature of the Service from time to time. It is your responsibility to ensure that your use of the API is compatible with the current version.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Effects of Termination

Upon termination of your account:

  • Your access to the Service will be revoked
  • Your shortened URLs may continue to redirect to their destination URLs, at our discretion
  • We may retain certain information as required by law or as necessary for our legitimate business purposes

Survival

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall ttny.io, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • The failure of shortened URLs to function properly
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Service by any third party

This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that ttny.io shall not be liable for user content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Limitation of Damages

To the maximum extent permitted by applicable law, in no event shall ttny.io's aggregate liability for all claims relating to the Service exceed the greater of:

  • $100 USD, or
  • The amount paid by you to ttny.io for the Service during the 12 months immediately preceding the event giving rise to the claim

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

ttny.io, its subsidiaries, affiliates, and licensors do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

This disclaimer of warranty applies to the fullest extent permitted by law in the applicable jurisdiction.

9. Indemnification

You agree to defend, indemnify, and hold harmless ttny.io, its parent company, subsidiaries, affiliates, and their respective directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service, including but not limited to your User Content and any use of the Service's content, services, and products other than as expressly authorized in these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right

This indemnification obligation will survive these Terms and your use of the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco, California, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.

Class Action Waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted. YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU AND TTNY.IO ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Notification of Changes

We may provide notifications about material changes to these Terms by:

  • Sending an email to the email address associated with your account
  • Posting a notice on our website
  • Displaying a notification when you log in to the Service
